1. General Agreement

By booking with Souwarayi Photography, the client agrees to the following Terms and Conditions. These terms ensure clarity, professionalism, and mutual understanding between the photographer and the client.

2. Booking and Payment Policies

• Deposit: A non-refundable deposit of 40% of the total package price is required to secure your booking.
• Final Payment: The remaining balance is due no later than 48hours before the session or event. Failure to pay by this deadline may result in cancellation.
• Accepted Payment Methods: Payments are accepted via bank transfer, credit card, or other specified methods.

3. Cancellations and Rescheduling

• Client-Initiated Cancellation: All cancellations must be made in writing via email. The deposit is non-refundable. If cancellation occurs less than 30 days before the session/event, the client will be charged 50% of the total package fee.
• Rescheduling: Rescheduling is permitted up to 30 days before the session/event and is subject to photographer availability. The deposit will be transferred to the new date.
• Photographer-Initiated Cancellation: In the unlikely event that Souwarayi Photography needs to cancel, the client will receive a full refund, including the deposit.

4. Session/Event Policies

• Punctuality: The client is responsible for ensuring punctuality. Time lost due to lateness will not be made up.
• Coverage: The photographer will cover all agreed moments as outlined in the contract. However, no specific images or outcomes are guaranteed due to the nature of photography and unforeseen circumstances.
• Weather & Environmental Conditions: The photographer is not liable for disruptions caused by weather, lighting, or other environmental factors. Clients may reschedule for severe conditions affecting the session.

5. Deliverables

• Image Delivery: Final edited images will be delivered within 4-6 weeks for standard sessions and 6-8 weeks for weddings or larger projects.
• Albums and Prints: Albums and prints will be delivered within 6-8 weeks of the design approval. Additional revisions may incur a fee.
• Delivery Method: Images are provided via an online gallery or USB, depending on the package. Printed products (albums, prints) will be shipped to the provided address.
• Image Quantity: The number of delivered images varies by package. The client will receive only edited, high-quality images; raw files will not be delivered.

6. Copyright and Usage Rights

• Ownership: All images are the intellectual property of Souwarayi Photography and protected under copyright law.
• Personal Use License: The client is granted a personal-use license to print and share the images.
• Prohibited Uses: Images may not be altered, sold, or used for commercial purposes without explicit written permission.
• Promotional Use: Souwarayi Photography reserves the right to use images for promotional purposes (e.g., social media, website) unless the client submits a written request for privacy before the session/event.

7. Liability

• Force Majeure: Souwarayi Photography is not liable for events beyond control, including but not limited to natural disasters, illness, or equipment failure. Every effort will be made to reschedule or resolve issues.
• Maximum Liability: Liability is limited to the total cost of the package purchased by the client.
• Third-Party Services: The photographer is not responsible for third-party vendor delays or errors (e.g., print labs, shipping companies).

8. Client Responsibilities

• Accuracy of Details: Clients must provide accurate details regarding the event, location, and timeline.
• Permits & Permissions: Clients are responsible for obtaining any required permits or permissions for the session location.
• Safety: Clients are responsible for ensuring a safe environment for all parties involved.

9. Add-Ons and Additional Costs

• Additional services (e.g., extra coverage hours, expedited editing, additional prints) are available upon request and will incur extra charges.
• Travel fees may apply for events located outside a 50-kilometer radius of Antwerp.

10. Dispute Resolution

• Governing Law: These Terms & Conditions are governed by Belgian law.
• Disputes: Any disputes will be resolved through mediation before legal action.

11. Privacy Policy

• Confidentiality: Souwarayi Photography respects client privacy and will not share personal information with third parties, except as required to fulfill services (e.g., print labs).
• Data Storage: Digital files are stored securely for up to 1 year after delivery.

12. Agreement Acceptance

By booking and making a deposit, the client acknowledges that they have read, understood, and agree to these Terms & Conditions.
